Code Enforcement

New York State Code states that property owners and occupants shall maintain clean, safe, and sanitary structures—inside and out. The interior of a structure and equipment therein shall be maintained in good repair, be structurally sound, and in a sanitary condition. 

Code Enforcement services

The Office of Code Enforcement administers and enforces all the provisions of Uniform, Energy and Town codes; regulations related to zoning, land use, nuisance housing, health and safety; and other matters of public concern. 

Code Enforcement Officers have the following powers and duties:

  • Receive, review, and approve or disapprove applications for:
    • building permits
    • certificates of occupancy/certificates of compliance
    • temporary certificates and operating permits
    • plans, specifications and construction documents submitted with such applications
  • Upon approval of applications, issue:
    • building permits
    • certificates of occupancy/certificates of compliance
    • temporary certificates
    • operating permits
  • Conduct a range of inspections for: 
    • construction
    • certificates of occupancy/certificates of compliance
    • temporary certificates
    • operating permits
    • fire safety
    • property maintenance
    • complaint investigations
    • all other inspections required or permitted under Town Code
  • Issue orders pursuant to Town Code violations including stop-work orders
  • Pursue administrative enforcement actions and proceedings
  • Collect fees as set by the Town Board
  • In consultation with the Town Attorney, pursue legal actions and proceedings as may be necessary to enforce the Uniform Code, the Energy Code, and Town Code, or to abate or correct conditions not in compliance with the Uniform Code, the Energy Code or Town Code.

Property owner responsibilities: Be a good neighbor, stay up to code!

Do your part to ensure public health and safety. Here are a few highlights:

  • Keep all garbage in approved containers such as totes, dumpsters, trash cans
  • Cut grass and weeds before they reach 10” high
  • Keep no more than one unregistered or uninspected vehicle on your property; it must be parked in the driveway and it must be owned by you
  • Place temporary signs on your own property, NOT in the right-of-way; remove when outdated
  • Do not create unreasonably loud, disturbing or unnecessary noise, particularly between the hours of 11:00 PM and 7:00 AM. This includes automobile horn honking, playing audio at high volume, excessive dog barking, and excessive noise from malfunctioning motor vehicles or mechanical equipment
  • Keep and maintain your compost pile (organic materials including leaves and grass clippings) 10 feet from the property line without obstructing drainage or utility access
