Pursuant to NYS V&T § 1660, Subdivision 8, parking of any vehicle is prohibited on all roads and shoulders, including New York State highways, from November 15 to April 1 between the hours of 2:00 a.m. to 7:00 a.m. (local time).
A. Any vehicles left, abandoned or permitted to remain parked unattended in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic. The Superintendent of Highways, his/her employees or any police officer may remove or cause to be removed any such vehicles to any location without any liability for damages to the vehicle. The owner or person in charge of such vehicle shall be required to reimburse the Town for the actual and necessary costs of removal and storage thereof before he/she is entitled to regain possession. Such reimbursement shall be in addition to any penalty for violation of this chapter as set forth in §
220-21.
B. It shall be the duty of the Superintendent of Highways and/or police officer, as the case may be, to ascertain to the extent possible the owner of the vehicle or person having same in charge and notify him/her of the removal and disposition of any vehicle removed as provided in this section and the amount which will be required to redeem same.
