PETITION IN SUPPORT OF STATE LEGISLATION (A7718) TO RESTORE AUTHORITY TO MUNICIPALITIES TO ESTABLISH RESIDENCY RESTRICTIONS FOR SEX OFFENDERS

Penfield residents and other interested parties are invited to sign this petition in support of state-wide legislation that will help improve public safety of children in Penfield and all of New York State. If enacted, this legislation would allow adoption of the Penfield Child Safety Act. 

Background

In February 2015, the Penfield Town Board proposed The Penfield Child Safety Act after learning that a level three sex offender was allowed, under state law, to reside in Penfield less than 200 feet from Veterans’ Memorial Park, home to Penfield Little League and countless other youth activities.  

The Penfield Child Safety Act would prohibit the residency of registered Level Two and Level Three sex offenders within designated Child Safe Zones, or 2,000 feet from any schools, parks, playgrounds, town facilities, or daycare centers. 

Less than two weeks after the Penfield Town Board proposed the Penfield Child Safety Act, the State Court of Appeals ruled that local governments no longer can have a say in where registered sex offenders are allowed to live. That decision struck down more than 100 existing local laws across New York State, thwarting efforts to enact the Penfield Child Safety Act.

To show his support for the Penfield Child Safety Act, on February 23, 2015, New York State Senator Rich Funke co-sponsored Senate Bill S.3925 to grant municipalities the authority to establish residency restrictions for registered sex offenders. The legislation passed the State Senate but not the Assembly. 

Senator Funke continued his work on behalf of the Penfield Child Safety Act, and on May 11, 2017, he announced the New York State Senate passed S.2178, his bill to restore local control over residency restrictions of sex offenders and better protect children. Now, Assemblyman Mark Johns is sponsoring legislation that will go before the New York State Assembly in June 2017 as bill A7718. The final step in the process requires Governor Cuomo’s signature.
